TERMS OF SERVICE
Once the appointment has been made, you the customer have agreed to these terms of service
Service Call Fee: Any and all appointments made, upon arrival is subject to a 1 hour minimum appointment of a $100 minimum service charge. We are not responsible for parts not available locally same day. If we come out to you to fix an issue we have not diagnosed first and parts are not available locally or same day, you will still be charged the 1hr minimum of $100
Estimates: If we have not seen the vehicle or diagnosed the vehicle, all prices given are for if the job goes smoothly and according to plan. If any additional work is needed to complete job / repair once working on the vehicle additional labor will be added to the bill. ex. we give a quote for labor for a ball joint of 2 hours, which is $200, if we have not seen the vehicle then this price is considered an estimate. If once we arrive and complete the job with no issues then the billed amount is $200. If once we arrive and complete the job with extra labor such as a stuck bolt that had to be cut and replaced, the additional work for cutting the bolt and additional new hardware could vary, such a job like this could vary from an additional $100 to $250. The additional work is seen as unforeseen circumstances.
Emergency Charge: $150 per emergency call. This is when we are needed right away, within the hour. This charge will also be applied calling after 6pm and we're needed right away. There is no guarantee your vehicle can be fixed the same day. Emergency charge must be paid for first to make an emergency appointment. NO REFUND AFTER PAYMENT HAS BEEN MADE.
Bundle Deals: We offer additional discounts for bundle deals on labor and parts. When quoted a price or estimate for a repair or service, if multiple jobs are done at once you may receive up to 25% off your repair. This up to 25% off will be applied automatically during the estimate/quote. You may not always see the discount listed on the estimate forum/text/over the phone, due to it automatically coming off in our system.
Warranty Coverage: Mobanics covers for a 12 month/12,000 mile warranty on our selected parts and labor, which ever comes first. Our location coverage for warranty jobs is only within a 10 mile radius of original repair location, or at customers house, coverage is only limited to Nassau/Suffolk county Long Island NY. All warranties are voided if another repair shop works on the vehicle.
Warranty Time Frame Coverage: Mobanics supplies a 12 month or 12,000 miles parts warranty of recipe date, which ever comes first. This warranty applies to only our approved quality supplied parts including labor.
Online Parts Order: If we are needed to order parts online to repair your vehicle all order must be paid for up front so that we may make the order. Parts ordered online are only made by the customers request. All parts we order online are within our recommendation for approved quality parts. If for any reason once order has been made and paid for, if the order is cancelled upon customers request there will be a fee to ship the part back for return. We are not responsible for shipping fees on delivery or for returns or shipping fees for warranty exchanges.
Customer Parts: We are not responsible for customer supplied parts in any way. If the part is faulty out of the box we hold no responsibility, if we install your part and its faulty or not working we are not responsible, you will still be charged accordingly to the job at hand.
Warranty labor: Mobanics supplies a 12 month or 12,000 miles labor warranty of recipe date, which ever comes first. Labor Warranty may not be added/approved to unapproved jobs, such as any unrecommended and/or customer wanted it done disregarding our recommendation and/or bypass procedures.
Warranty on Our Approved supplied parts: We will cover all labor/diagnosis charges if our supplied parts fails within the warranty timeframe coverage. We do not cover if part was neglected/in an accident and damaged beyond failed Specification.
Warranty on Customer supplied parts: This warranty only covers if our work was faulty. If the part installed is faulty or damaged or fails after installation we do not cover labor warranty and all necessary time and diagnostic will be billed. We do not cover labor if part was neglected/in an accident and damaged beyond failed Specification. We DO NOT warranty customer supplied parts or unapproved quality parts for the customer. (receipt will state, "APPROVED PARTS" or "NOT APPROVED PARTS" or "CUSTOMER SUPPLIED PARTS NO WARRANTY" for warranty coverage. warranty coverage will be stated on your receipt.
Diagnosis Fees: $100hr is the electrical/basic diagnosis fee. A minimum charge of 1 hour for diagnosis is applied to the bill. If vehicle takes 3 hours to diagnosis the electrical problem, the total for diagnosis is billed for $300. If the vehicle take 30 minutes to diagnosis, the total for diagnosis is billed for $100.
Disassembly / Tear down Diagnostic Fees: A tear down diagnostic fee is when we have to take apart items or components to find the problem during diagnosis. ex. starter on X vehicle takes 30 minutes to electrically diagnosis and 1.2 hours book time to remove and bench test if necessary, total billed will be $50 for electrical diagnosis, and $120 for disassembly, making the total billed $170.
Hourly rate: $100hr is our flat rate / book time charge. A flat rate is defined by the amount of time taken to complete the job on hand. We use real time labor guide to check flat rate on repair jobs. ex; flat rate for (x) year (x) make (x) model starter is 2 hours. That's a charge of $200 for the labor on that job. whether the job take us 2 hours, 1 hour or 3 hours to complete, $200 will be added to the bill, with the exception of addition parts and service. if the customer supplies parts that are incorrect for the job at hand, labor will still be applied to the bill for the service that was done. This rate is only if we have seen the vehicle first. If we have not seen the vehicle first then the labor rate may vary due to unforeseen circumstances.
Trip Charge: A trip charge will be added to the bill depending on the distance from the office. First 30 minutes of travel is free. A charge of $25 will be added to every additional 15 minutes of travel needed to reach your vehicle's destination.
Inspection Services: When purchasing our services you are hiring Mobanics to evaluate the overall condition of a vehicle. We will perform a visual inspection and check functionality of components included in our report. If we are able to conduct a test drive we will do so. In the event a test drive is not possible we will document it on the report. During our inspection we do not disassemble any part of the vehicle to further diagnose any issues found. Inspections may be affected by the vehicles cleanliness and location. Although we do ask the car to be clean and in a well lit area this may not always be the case. As such we ask our customers to take all necessary steps to ensure ideal conditions when inspecting the vehicle. Mobanics will not clean or otherwise alter the vehicle to improve inspection conditions.
Limitations/Warranty/Guarantee pre-purchase inspection: Mobanics services are limited to vehicle inspections. We are not affiliated with any sellers nor will we verify a sellers legal ownership and right to sell the vehicle. Our inspections shall not be held as any warranty or guarantee on behalf of the seller. Mobanics and its products shall not be used to substitute any safety or emission inspections required by law. Mobanics will not advise you on whether to purchase a vehicle or not and shall not be held responsible for decisions made after the report has been obtained. Mobanics will not be responsible for damages that occur after our inspections and before and after you purchase the vehicle.
Cancellation/Refunds pre-purchase inspection: All requests for cancellation must be made at least 24 hours before inspection appointment in order for refund to be processed. Cancelled inspections less than 24 hours before the appointment will not be refunded. If an appointment is cancelled due to Mobanics inability to perform the inspection due to weather, loss of property or any unforeseen event a refund will be issued for your inspection or you will be provided with credit to reschedule the inspection.
NON Payment: Once finished with our job and you are billed accordingly, if you refuse to pay or cant afford to pay (outside of payment agreement contract) we may keep you vehicles keys until a payment agreement or payment is made. once a payment has been made we may either drop off your keys to you or mail them back. If refusal to pay or to make payment agreement, Mobanics may put a Mechanics lien on the vehicle that we worked on, and/or tow the vehicle, and in addition, possible file for theft of services, which is a criminal charge.
Late Fee: If a balance is owned, a $20 late fee will be added to the bill after 7 days from the original receipt date from non payment. In addition, a $40 fee will be added every 30 days after non payment from the original receipt date.
Coupons: unless described, all coupons are for labor rates only. Coupons may not be applied to any “cash price only” receipt, any jobs with customer supplied parts or bundle deals, bundle deal discounts are automatically applied during estimate/quote/text/email/over the phone. (please see "Bundle Deals" above for more information)
LIMITATION OF LIABILITY: Mobaincs DOES NOT MANUFACTURE VEHICLES NOR IS THE SELLER AND SHALL NOT BE HELD RESPONSIBLE FOR ANY MANUFACTURER DEFECTS OR UNDISCLOSED/UNREPORTED DAMAGES. MOBANIC'S CONDUCTS VISUAL INSPECTIONS TO IDENTIFY PREVIOUS REPAIRS AND DAMAGES TO MECHANICAL AND STRUCTURAL COMPONENTS AND DOES NOT GUARANTEE THE STRUCTURAL INTEGRITY OR OVERALL SAFETY AND ROAD WORTHINESS OF ANY VEHICLE. YOU AGREE THAT MOBANIC’S LIABILITY IS LIMITED TO REFUNDING FULL PRICE OF INSPECTIONS IN THE EVENT OF DISSATISFACTION WITH OUR SERVICES OR DAMAGES/INJURIES/ACCIDENTS OR ANY OTHER CLAIMS THAT OCCUR AFTER INSPECTION DUE TO UNREPORTED/UNDISCLOSED DAMAGES OR MANUFACTURER DEFECTS.
Changes: Mobanics reserves the right to alter these terms at any given time. Any changes will be posted to this website before they take place. Any use of the website or mobile device application by you after such notice shall be deemed to constitute acceptance of such changes, modifications, additions, or deletions.
Sever-ability: If any section of this agreement is found by competent authority to be invalid, illegal or unenforceable in any respect and for any reason, the validity, legality and enforce-ability of the unaffected remainder of such section and the remainder of the agreement shall continue in effect.
Miscellaneous: These Terms and Conditions constitute the entire agreement of the parties with respect to the subject matter hereof and supersede all previous written or oral agreements between the parties with respect to such subject matter. These Terms and Conditions shall be construed in accordance with the laws of the State of New York, without regard to its conflict of laws rules. You hereby consent to the personal jurisdiction of any state or Federal court in the State of New York, acknowledge that venue is proper in the State of New York, agree that any action related to these Terms and Conditions must be brought in a state or Federal court in the State of New York and waive any objection that may exist, now or in the future, with respect to any of the foregoing. No waiver by either party of any breach or default here-under shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.
